St Moritz Hotel, Villa and Apartment Terms and Conditions
HOTEL TERMS AND CONDITIONS

1. BOOKING

1.1 A non-refundable 25% deposit is taken upon booking for hotel stays, full balance is payable 24 hours before arrival.

1.2A non-refundable 50% deposit is taken upon booking for package reservations, with the full balance due 6 weeks prior to arrival.

1.3 Any special offers cannot be used in conjunction with any other offer, and if conditions are not fully met, then the standard tariff will apply.

1.4 Booking alterations must be made 6 weeks prior to arrival and will be subject to the agreement of St Moritz Management.

1.5 Pets are allowed in rooms 01A and 010A, only, at an additional charge of £20 for a dog (1 dog allowed per request), dog rules apply.

1.6 While we make every effort to ensure pricing and availability are accurate at the time of booking, occasionally errors may occur due to system or booking engine faults. In such cases, we reserve the right to correct the error and will contact you as soon as possible to offer the option to rebook at the correct rate or cancel the booking with a full refund. We are under no obligation to honour bookings where pricing errors are obvious and could have reasonably been recognised as such.

Pets are not allowed in any other rooms/villas/apartments when renting. Only property owners are permitted pets in their accommodation.

2. CANCELLATIONS

2.1 Cancellations must be received in writing.

2.2 All hotel cancellations forfeit 100% total cost of the stay.

2.3 Monies paid at the time of booking are non-transferable, nor will be given as a credit.

2.4 Please Confirm that your own suitable travel/holiday insurance is in place at the time of booking.

2.5 Package reservations are non-refundable and charged at 100% of the cost of the stay within 6 weeks of arrival.

2.6 Group cancellations (6 bookings or more) – are liable for the total cost of the group booking within 6 weeks of arrival.

2.7 In the event of cancellation we will enforce our terms and conditions, please confirm you have adequate travel insurance cover to cover the cost of your holiday should you have to cancel.

3. ARRIVAL/OCCUPATION

Baby listening facilities are not available. The safety and wellbeing of all children is solely the responsibility of the parents/guardians. Travel cots can be provided and will be placed within the parent/guardians’ room.

3.1 . All purchases must be signed for and proof of name and room number will be required.

3.2 Hotel, villa and apartment guests are able to use all leisure facilities as part of their room rate. Spa, Restaurant and Bar facilities are also available for guest’s use where charges will apply.

3.3 In accordance with the no-smoking legislation, St Moritz Hotel is a smoke-free premise and smoking is not permitted. The designated smoking area is adjacent to the reception. Smoking in a room will incur an additional cleaning charge of £140.00 to render the room smoke free again.

4. DESCRIPTION

Whilst St Moritz makes every effort to ensure the accuracy of the property descriptions they are inevitably subjective and are for guidance only. If there are points of particular importance please contact St Moritz to clarify information.

4.1 Whilst St Moritz has taken all reasonable steps to ensure that the information contained in its brochures, websites, tariffs, leaflets, advertisements and any other form of promotional material is accurate, St Moritz reserves the right to alter, substitute or withdraw any service, facility or amenity.

4.2 If, in the interest of health & safety, a facility has to close, St Moritz will endeavour to re-open it as soon as possible.

5. LIABILITY

St Moritz cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property and its plumbing, gas, electrical or otherwise, or exceptional weather.

5.1 No responsibility is accepted for loss or damage of property, vehicles or vehicle contents belonging to the Lead Guest or any member of the party during the occupancy.

5.2 If due to reasons beyond the control of St Moritz, the accommodation is not available whatsoever, St Moritz will refund the deposit, but St Moritz will be under no further liability towards you.

5.3 The hotel reserves the right to refuse any bookings.

5.4 Failure to comply with any of the booking conditions may result in the party being asked to leave immediately.

VILLA TERMS AND CONDITIONS
  1. THE CONTRACT

The contract entered into is between St Moritz Hotel & Garden Villas Ltd. (St Moritz) and the person completing and signing the Booking Form (the Hirer). The contract is not effective until the required payment has been received and confirmation sent from St Moritz to the Hirer.

2. BOOKING

Bookings cannot be accepted by: a. Persons under the age of 25 years. b. Parties where the majority of members are younger than 25 years (except families or supervised groups).

2.1 The number of persons occupying a property must not exceed the maximum stated in the current property description. (Babies under 2 are not normally counted as a member of a party).

2.2 The person who signs the booking form (the Hirer) will be responsible for all persons included on the form and should ensure that they are aware of the booking conditions.

2.3 St Moritz reserves the right to decline any booking or refuse to hand over a key to any person who has not complied with the booking conditions.

2.4 While we make every effort to ensure pricing and availability are accurate at the time of booking, occasionally errors may occur due to system or booking engine faults. 3. RESERVATION

3.1 Provisional reservations can be accepted by telephone, with the guarantee of debit card details and must be confirmed within 7 days by the receipt of a booking form. We charge a £45 booking fee and the required deposit or total tariff.

3.2 Provisional reservations will be cancelled after 7 days without further reference.

3.3 If the balance is not received within the time specified, the agent reserves the right to take the full balance payment utilizing the PCI (Payment Card Industry) code, and should this not be successful, St Moritz will cancel the booking and retain the deposit plus booking fee.

3.4 Bookings made within six weeks of the start of the holiday require payment in full at the time of the booking.

3.5 While we make every effort to ensure pricing and availability are accurate at the time of booking, occasionally errors may occur due to system or booking engine faults. In such cases, we reserve the right to correct the error and will contact you as soon as possible to offer the option to rebook at the correct rate or cancel the booking with a full refund. 4. CANCELLATION

4.1 Once a booking is confirmed, the Hirer is responsible for the total cost of the holiday. ‘Total’ means both Deposit and Balance payments.

4.2 In the event of cancellation by the Hirer, St Moritz will endeavour to re-let the property, and if successful, may refund any monies paid less the deposit and booking fee, which is non-returnable.

4.3 St Moritz reserves the right to utilize the PCI (Payment Credit Industry) transaction code from previous payments for any outstanding balance in the event of cancellation or non-attendance.

5. CANCELLATION INSURANCE

St Moritz cannot arrange Holiday Cancellation Insurance on your behalf. We strongly recommend that your own appropriate Holiday Cancellation Insurance is in place at the time of booking.

6. BOOKING ALTERATIONS

6.1 Any change in holiday dates will be subject to the agreement of St Moritz.

6.2 Any request by the Hirer for the transfer of booking to another property will be treated as a cancellation of the original reservation.

6.3 If, for reasons beyond its control, the Agent has to cancel or alter arrangements made for the Hirer, it will make every effort to offer an alternative property if one is available.

6.4 If the Hirer does not accept the alternative offered, the Agent will return to the Hirer any monies paid, whereupon the liability of St Moritz Hotel & Garden Villas Ltd. will cease.

7. DAMAGE DEPOSIT

7.1 Damage Deposit Requirement: To ensure the well-maintenance of the villa and its contents, a damage deposit of £350 is required from all guests staying in our self-catering villas. This deposit is in addition to the rental fee and must be paid in advance.

7.2 Deposit Payment: The damage deposit must be paid in full before your stay, along with the rental fee, as specified in the booking agreement. Payment can be made through the provided payment methods, and the deposit will be held securely throughout your stay.

7.3 Inspection and Refund: After your stay and upon inspection of the villa, the damage deposit will be refunded to you within 14 days, minus any deductions for damages or breakages. The deduction amount, if any, will be determined based on the cost of repair, replacement, or cleaning necessitated by any damages.

7.4 Deduction Limit: The damage deposit is intended to cover reasonable costs for damages or breakages incurred during your stay. However, in the event that damages exceed the £350 deposit, you may be liable for additional costs to cover the full extent of repairs, replacements, or cleaning.

7.5 Notification of Damages: In the event that you notice any damages or breakages upon arrival, it is your responsibility to promptly notify the villa management or owner to avoid potential disputes regarding responsibility.

7.6 Use of Deposit: The damage deposit shall not be used as a substitute for the rent owed for your stay, and it will only be utilized to address damages or breakages incurred during your occupancy.

7.7 Return of Deposit: The damage deposit will be returned to the account or payment method used for the initial deposit within the specified time frame, after a satisfactory inspection of the villa.

7.8 Additional Charges: Should the cost of repairing damages exceed the damage deposit, the guest will be responsible for paying the additional charges to cover the excess cost.

8. OCCUPANCY

Occupancy shall be from 4.00 pm on the day of arrival to 10.00 am on the day of departure, unless special arrangements have been made (the housekeepers have only a limited time to prepare the property for the next guests, and you are asked to respect this). If special arrangements have not been agreed upon, guests will be charged a late departure fee of £100 per hour.

9. SERVICES

The Hirer must pay St Moritz for all telephone calls made during the occupation.

9.1 Wi-Fi access is free of charge, however, because of our rural location it can be intermittent, we can only receive a limited bandwidth from BT.

9.2 Linen for beds and bath & hand towels are provided per person and are included in the rental price.

9.3 Electricity is included in the rental price.

9.3.1 Electric car charges are not included in this. It is prohibited to charge any electrical vehicle via villa electricity. If a guest is reported doing so the £350 damage deposit will be forfeited. We do have electric charging points opposite the main hotel reception.

9.4 Use of leisure facilities is included in the rental price.

9.5 All purchases must be signed for.

9.6 All outstanding balances are payable upon departure. If you have not settled upon checkout, then the PCI (Payment Card Industry) transaction code from previous payments will be utilised.

11.2 Whilst St Moritz has taken all reasonable steps to ensure that the information contained in its brochures, websites, tariffs, leaflets, advertisements and any other form of promotional material is accurate, St Moritz reserves the right to alter, substitute or withdraw any service, facilities or amenity.

11.3 If, due to reasons beyond the control of St Moritz, a facility has to close, St Moritz will endeavour to re-open it as soon as possible.

12. LIABILITY

12.1 St Moritz cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property and its plumbing, gas, electrical or otherwise, or exceptional weather.

12.2 No responsibility is accepted for loss or damage of property, vehicles or vehicle contents belonging to the Hirer or any member of the party during the occupancy.

13. COMPLAINTS

13.1 If in the opinion of the Hirer there are grounds for complaint, it is the duty of the Hirer to take it up with St Moritz immediately or during occupancy to allow remedial action to be taken. The Hirer should contact reception on (01208) 862 242.

13.2 It is specifically agreed that failure by the Hirer to notify St Moritz of any complaint in accordance with the timescale set out in clause 13.1 will entitle St Moritz to refuse to entertain the complaint, irrespective of its merits.

13.3 St Moritz is a member of Visit Cornwall and adheres to its code of practice.

14. WAIVER The failure of St Moritz to enforce or exercise, at any time, or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.

15. LEGAL PROVISIONS

15.1 The law of England governs the construction, and performance of this Agreement and the parties submit to the jurisdiction of the English Courts.

15.2 The Hirer agrees that the contract with St Moritz is made at St Moritz’s premises and that any proceeding between the parties shall be conducted in the County Court nearest to St Moritz.

15.3 Clause headings are for convenience only and do not form part of or affect the interpretation of the Agreement.

16. DOGS

16.1 Pets are only permitted with the prior consent of St Moritz Hotel or the Owners and where such pets are permitted, they are to be well-behaved, kept under control and exercised off the premises.
16.2 Pets are not permitted in the bedrooms or on the furniture and neither St Moritz Hotel nor the Owners can accept responsibility for their safety. Dogs must not be left unattended in the property or in a vehicle outside of the property at any time.
16.3 A charge will be made for pets in the sum of £20 per night per dog per stay, which is payable to St Moritz Hotel as agents for the Owner at the time of booking. Guide or hearing dogs are permitted to stay at no extra charge.
16.4 It is your responsibility to ensure your pets do not disturb those in adjoining properties or nearby and, on departing from the property, it is your responsibility to ensure that you have cleared up after your pets and that there is no trace of your pets having been at the property. If any additional cleaning is required that may incur an additional charge will be payable by you at the discretion of St Moritz Hotel, this will be taken with the card details on file. Any damage caused by pets must be reported to St Moritz Hotel immediately.
16.5 St Moritz Hotel reserves the right to deduct the full Damage Deposit in the event of dog mess having to be cleared after departure.
16.6 Where the description of a property states ‘no pets’ or otherwise restricts the keeping of pets at the property, St Moritz Hotel and/or the Owners cannot guarantee that there has been no pets previously kept at the property.
16.7 Pet owners must ensure that their pets are free from all parasites and fleas before they occupy the property. Failure to do so may incur additional charges.
16.8 If you or your guests have an allergy to animals, please be aware that St Moritz Hotel cannot guarantee that an assistance dog, or other animals, have not stayed in a particular property. St Moritz Hotel cannot accept responsibility for any health condition which may occur as a result of any animals having been present in a property.
16.9 You must be mindful of other people and animals, including livestock, in the vicinity so as not to allow your pet to become a nuisance.
16.10 You should provide pet bedding and necessary equipment, including food, water bowls and towels.

APARTMENT TERMS & CONDITIONS

7. DAMAGE, LOSS AND NUISANCE

7.1 The Hirer agrees:
a. The PCI (Payment Card Industry) Code will be utilised for a sum of up to £350 should any damages or additional charges be incurred during the occupation of the accommodation.
b. That the supervision of children, babies and any adults requiring care remains the responsibility of the Hirer at all times.
c. To be responsible for leaving the accommodation in good order and clean condition, otherwise, a cleaning charge will be levied.
d. To pay for any damage or loss however caused, excluding reasonable wear and tear, incurred during the occupation.
e. Not to cause nuisance or annoyance to occupants of nearby properties.
f. To allow reasonable access to the property by the Agent if it is deemed necessary.

7.2 If in the opinion of St Moritz, or Owner of the property, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties, the contract may be discharged and St Moritz may repossess the property immediately. The Hirer will remain liable for the whole cost of hire and no refund shall be due.
7.3 In accordance with the no-smoking legislation, St Moritz Hotel is smoke-free premises and smoking is not permitted. The designated smoking area is adjacent to reception. Smoking in an Apartment will incur an additional cleaning charge of £140.00 per room to render the Apartment smoke free again.

8. OCCUPANCY

Occupancy shall be from 5.00 pm on the day of arrival to 9.00 am on the day of departure, unless special arrangements have been made (the housekeepers have only a limited time to prepare the property for the next guests, and you are asked to respect this).
